Information about H-1B, TN, E-3 and O-1 status

Maintaining your H-1B, TN, E-3 and O-1 visa status

  • Prior to any changes in employment, OIVS must be consulted to determine if an H-1B/TN/E-3/O-1 amendment is required. Changes in employment such as position title, position responsibilities, degree requirements for the position, sponsoring department, work location and number of hours worked must be communicated to OIVS. Failure to notify OIVS prior to a material change in employment may place CHOP and the H-1B/TN/E-3/O-1 employee in violation of immigration rules and regulations.
  • For employees continuing in H-1B/TN/E-3/O-1 status, an extension must be properly filed prior to the expiration of their status. Requests for an extension must be submitted in the Service Center by your Manager or Department Representative.
  • H-1B/TN/E-3 and O-1 employees are not permitted to accept payment from sources outside of CHOP.
  • I-94: All nonimmigrants are issued an I-94 upon each admission to the US. If you are a nonimmigrant, please remember to check your I-94 after each entry to the US through this website. If you are entering via a land border, check your paper I-94 to ensure the information is accurate. Please report any errors on your I-94 immediately to CBP and OIVS.   • Residential Address Change: Nonimmigrants in H, TN, O-1 and E-3 status must notify USCIS within 10 days of moving. Form AR-11, Change of Address, can be completed online.
  • Passports: All nonimmigrants are required to maintain a valid passport. Expiring passports should be renewed as soon as possible, due to potential delays resulting from the COVID-19 pandemic. Please be aware that CBP officers have the discretion to shorten the I-94 admission record to match one's passport expiration date.

For your re-entry into the US in H-1B and O-1 status

You Will Need:
  • A valid passport (for more than six months from date of intended return)
  • A valid H-1B or O-1 visa stamp
  • Original valid Form I-797 H-1B or O-1 Notice of Approval
  • Employment verification letter confirming continued employment at CHOP. Please submit a Service Center request.
  • Copy of I-129 petition

For your re-entry into the US in TN status

You Will Need:
  • A valid Canadian or Mexican passport (for more than 6 months from date of intended return)
  • If a Mexican national, a valid TN visa stamp
  • TN support letter specifying the TN profession and duration of employment
  • Requisite educational or occupational credentials for the TN profession (i.e. degree, license, etc.)

For your re-entry into the US in E-3 status

You Will Need:
  • Valid Australian passport (for more than 6 months from date of intended return)
  • Valid E-3 visa stamp
  • Employment verification letter confirming continued employment at CHOP (this should be requested in the Service Center)
  • Copy of valid Labor Condition Application (LCA)
  • If you changed to or extended E-3 status in the US, original valid Form I-797 E-3 Notice of Approval and copy of I-129 petition
